On September 28, 2018 and October 25, 2018, the US Army Corps of Engineers forwarded requests for additional information from two NOAA agencies to the Summer’s End Group. When we received these documents via the Freedom of Information Act (FOIA), the actual information requests were redacted (blacked out) since they had been initiated by a different agency than the Army Corps. We are currently waiting to receive the redacted portions from the originating federal agencies.
The two agencies requesting additional information are both within the National Marine Fisheries Service (NMFS), a division of the National Oceanic and Atmospheric Agency (NOAA).
The NMFS Protected Resources Division (PRD) is responsible for reviewing impacts to endangered and protected marine species, such as sea turtles, under Section 7 of the Endangered Species Act.
The NMFS Habitat Conservation Division (HCD) is responsible for reviewing impacts to Essential Fish Habitat (EFH) under the Magnuson-Stevens Fisheries Conservation and Management Act.
