SCB Responds to DPNR: No “Good Cause” to Extend Permit

On May 20, 2025, DPNR responded to Save Coral Bay’s request regarding the status of the expired CZM permit for the Summers End Group.  In their response, DPNR states that the Consolidated CZM Permit is “null and void” due to its expiration a year after issuance without any request from SEG for extension.

DPNR also wrote that “the permittee can request an extension in writing and demonstrate to the satisfaction of the STJ Committee or Commissioner that good cause exists for granting such extension.”  However, based on our analysis of the terms of the permit, the relevant Virgin Islands Code, and the CZM Rules and Regulations, we do not believe that SEG can demonstrate “good cause” for their failure to either commence construction or request an extension for several years.

The letter below was sent to DPNR/CZM on May 23, 2025, explaining why there cannot be “good cause” for permit extension, and if there is a request from SEG there must be a public notice and an opportunity for public comment, and the request must be reviewed by the St John CZM Committee.
