Letter to Army Corps Rebutting “Not Likely to Adversely Affect” Findings

Following an in-depth review of the October 5, 2024, letter from the Army Corps to NOAA NMFS Protected Resource Division, we have written an in-depth rebuttal to the Army Corps letter.  We’ve identified errors, illogical conclusions, and statements made without any scientific basis.  The net result of this review is a lengthy letter directed at the action agency (Army Corps) and copied to NOAA NMFS, the EPA, and legal counsel for Save Coral Bay.

We are hopeful that after reading our analysis of the Corps’ faulty findings, NOAA will require formal consultation under Section 7 of the Endangered Species Act, and not the “informal expedited consultation” requested by the Corps on October 5, 2024.
