SEG Powers of Attorney

The Powers of Attorney granted to SEG by the owners of 13 Remainder, 13-A, and 13-B were all limited to a grant of authority to “apply for permits.”  None  of these PoA’s granted SEG the authority to perform construction.  The PoA’s were also limited in time.

In their CZM Permit Application, SEG swore that they had the “irrevocable power …”  This was untrue at the time it was said, and should have resulted in the CZM permit application being deemed “incomplete” by DPNR.  It should also have resulted in a rejection of the Army Corps permit application once USACE was notified that SEG did not have the authority to conduct the development described in the USACE permit application.

The Powers of Attorney are shown below:

First Army Corps Permit

In April 2014 SEG filed its first permit appication with USACE.  In this application Chaliese Summers signed the affirmation stating (under penalty of law) that “I possess the authority to undertake the work described herein.”

In fact, in April 2014 SEG did not have the authority to undertake work on any of the marina parcels.  The Powers of Attorney for 13A and 13B Carolina, for example, solely gave SEG the authority to “apply for permit.”
