Save Coral Bay Files Lawsuit in Superior Court

The conduct of the July 2020 Committee of the Whole made it abundantly clear that the Legislature wasn’t concerned about the clearly unorthodox and most likely illegal “consolidation and modification” of the 2014 CZM permits for the Summers End Group.  The hearing was conducted in a manner which prevented a balanced presentation of issues, with limited time allowed for opponents, and unlimited time allowed for Summers End.

With that knowledge, Save Coral Bay, shortly after the July 2, 2020, hearing, and with an awareness that the Board of Land Use Appeals would likely dismiss the February 2020 appeal, we decided to challenge the Governor’s clear abuse of the enforcement provisions of CZMA 911(g) in Virgin Islands Superior Court.

On  July 21, a few weeks following the Committee of the Whole, the lawsuit was filed.

One immediate consequence of the filing of the lawsuit was my being ejected from the St John CZM Committee by Governor Bryan.  Ironically, I had been appointed by Governor Mapp on October 12, 2018, and removed by Governor Bryan on September 22, 2020, just three weeks before my term would have ended.
