Committee of the Whole Rejects Permits

There were so many major issues raised in the October 2019 Committee of the Whole, that the Legislature could not, in good conscience, move forward with the Summers End CZM permits.  These issues included:

  • Failure to “consolidate” the land and water permit as required by BLUA
  • Failure to remove two parcels sold to a third party (“Voyages Building”)
  • Ongoing legal dispute with the Philllips family regarding purchase of Coccoloba Plaza
  • Objections by the Clendinen family to highly unfavorable lease terms agreed to by an elderly person with cognitive impairment without benefit of legal counsel
  • Improper computation of Trust Land Occupancy Fees
  • Improperly reauthorized CZM Permit

The Legislature did not take action in Session, and in December the permits were sent back to Governor Bryan with a letter clearly identifying their deficiencies and measures that needed to be taken before the Legislature could reconsider them.  This letter is shown below:

We had high hopes that this full-on rejection would send the Summers End Group back to the St John CZM Committee for a thorough review of their heavily revised plans and resolution of all of the property legal interest issues identified in the hearing.

But apparently Summers End, and in particular, Ms. Chaliese Summers, had other thoughts:  she believed she could have the Governor unilaterally modify the approved permits and in so doing rectify all of the issues identified by the Legislature.  And so that is exactly what she did.
