The modifications to Summers End Group CZM permit made by Governor Albert Bryan in December 2019 are not authorized under the Virgin Islands Coastal Zone Management Act. The Governor, in liaison with Chaliese Summers, has concocted a weak interpretation of a permit enforcement provision to justify his unilateral changes to a CZM approved permit. This action cannot go unanswered.
The documents below are the principal legal filings in the BLUA appeal. Given the extraordinary nature of the Governor’s actions, it is quite possible that BLUA will be unable to hear the appeal, but this step is necessary to preserve our rights for possible future legal action.
