Board of Land Use Appeals Issues Decision on SEG Permits

The Board of Land Use Appeals rendered its written decision in the Virgin Islands Conservation Society and Moravian Conference administrative appeals of the CZM decisions for the Summers End Group.

The BLUA decision has these main points:

  • The two CZM permits – Land and Water – are ordered to be consolidated.
  • The performance bond is increased to $10 million.
  • The decision of the St John CZM Committee to approve the individual permits is affirmed.

Because of substantial ambiguity in this decision – for example how could BLUA affirm the CZM Committee action and at the same time say that it was incorrect because it was based on two permits and not one consolidated permit – it is very likely that the BLUA decision will be appealed in VI Superior Court.
